This Office offers the following services:
- CONTRACT VERIFICATION
- INDIVIDUAL PROCESSING
This service is extended to overseas Filipino workers (OFWs) who
are renewing their employment visas, or transferring to a new
employer after the old contract has expired or prematurely
terminated with ID 522 from HK Labour Department.
The verification
process basically ensures that the contract is in compliance
with labor and immigration laws of Hong Kong.
For OFWs
renewing (with the same employer) their contracts, the
procedure of processing their employment contract shall be under
“EXPRESS EMPLOYMENT CONTRACT PROCESSING” as follows:
-
Secure OFW
Information Sheet from the Consulate guard
(DOWNLOADABLE FORM). Fill up
completely the Information Sheet. [FORM A]
-
Attach
completely filled-up OFW Information Sheet to the New
Employment Contract and other required and/or supporting
documents.
-
Give the
above-mentioned documents to the Cashier together with the
exact amount of HK$297.50 as processing fee. Get only the
Original Receipt (OR-white).
-
Bring the O.
R. after 3 working days to COUNTER 13 for the release of the
employment contract and other documents.
NOTE: The
applicant will receive a call within 24 hours upon submission of
contract from POLO staff if there is any concern/problem to
address it.
Those OFWs
transferring to a new employer after finishing the former
contract can process directly at Counter 17, while those
with pre-terminated contracts must secure an ID 522 at
the HK Immigration Department before they can process their new
contract over-the-counter in the Consulate.
- PROCESSING BY EMPLOYER THROUGH DIRECT/NAME
HIRE PROGRAM
A QUALIFIED EMPLOYER who wanted to hire directly
a domestic helper shall personally process the employment
contract. She should bring all the required documents and appear
before POLO staff for PERSONAL INTERVIEW.
Only the following employers are qualified
under the direct/name hire program.
- Employers who are immediate members of the family of
Heads of State/Government;
- Employers who are Ministers, Deputy Ministers and other
Senior Government Officials of the host country;
- Employers who are senior officials of the diplomatic
corps and duly recognized international organizations;
- Employers residing in countries where Foreign Placement
Agencies do not operate;
- Employers who are assigned or re-assigned to Hong Kong
SAR from other countries and who will bring with them their
household workers;
- Filipino employers who are residents in Hong Kong SAR
and who will employ their household workers in the
Philippines;
- Employers who wish to re-employ their former household
workers who have left Hong Kong SAR and stayed in the
Philippines for some time; and
- Employers who will employ those household workers who
have had a previous employment in Hong Kong to include those
workers who had been terminated and had left Hong Kong.
NOTE: Household Service Workers coming to Hong Kong on
employment visa for the FIRST TIME are NOT ALLOWED under the
Name/Direct Hire except those whose employers fall under nos. 1
to 3 above. The employment contracts of first timers shall only
be processed through placement agency. Newly hired or those
without previous experience in Hong Kong or those who have
previously worked in Hong Kong or in other country WITHOUT
having completed/finished one employment contract term has to
comply with the POEA package of reforms for HSWs effective 16
December 2006 as can be seen elsewhere here.
THE PROCEDURE FOR DIRECT/NAME HIRE PROCESSING ARE AS
FOLLOWS:
Important: Please see other requirements under POEA
2007 POLICY GUIDELINES which can also be found somewhere here.
- Secure Employer’s Information Sheet [FORM B]
(DOWNLOADABLE FORM) or you may
get it from
Counter 16. Fill up completely the
Information Sheet and attach recent picture (“2 X 2”)
- Attach completely filled-up Employer’s Information Sheet
to the Employment Contract and other required and/or
supporting documents.
- Give the above-mentioned documents to the POLO Staff for
evaluation. If approved, the POLO Staff will issue a receipt
in the amount of HK$297.50 as processing fee. Get the
Original Receipt (O.R. white).
- Bring the O.R. after 3 working days to Counter 13 for
the release of employment contract and other documents.
- Proceed to the HK Immigration Department for the
processing of employment visa. Normal processing time: 4 to
6 weeks.
- Upon approval of the employment visa, the employer
should send to the worker/helper in the Philippines the
following documents:
- the visa sticker;
- the verified employment contract;
- plane/air ticket or Ticket Exchange Voucher (TEC);
and
- endorsement letter to the POEA which is signed by
the Labor Attache of HK SAR
- Upon receipt, the worker/helper should proceed to the
Philippine Overseas Employment Administration (POEA), Name
Hire Processing Unit, Household Worker’s Processing Center,
located at the G/F, POEA Bldg., (Blas F. Ople Bldg.), corner
EDSA and Ortigas Ave., Mandaluyong City with telephone nos.
(632) 722-1160 & 722-1193, or to any of its nearest
District/Regional Office to submit the endorsement letter
from the Labor Attache and photocopies of all the other
documents, together with the photocopy of his/her passport
for the final processing and issuance of Overseas Employment
Certificate (OEC). (Note: Original copies of the
aforementioned documents are also to be presented for
verification)
- The worker/helper should also undergo a medical
examination in a POEA Accredited Hospital or Clinic. The
cost of said medical examination should be shouldered by the
employer.
- If all the papers are in order, the worker/helper will
be required to attend the Pre-Departure Orientation Seminar
(PDOS) conducted by the Overseas Workers Welfare
Administration (OWWA). The following fees are to be paid:

Employer = US$100 (or
its Peso equivalent) – POEA Processing Fee
US$25 (or its Peso equivalent) – OWWA Membership
- Helper = Ph
P900 –
PhilHealth Membership
- An Overseas Employment Certificate (OEC) will then be
issued to the worker/helper and he/she could now
book/confirm her flight to Hong Kong, SAR. The OEC would
also exempt the worker/helper from paying the Philippine
travel tax and the International airport terminal fee.
- PROCESSING THRU EMPLOYMENT AGENCY
Placement agencies shall process employment contracts of
domestic helpers through “”File Easy”, the procedure of
which is as follows:
- Submit all the employment contracts and supporting
documents of domestic helpers together with the transmittal
form and tally sheet to Counter 15.
- Upon receipt of filled up transmittal form and tally
sheet from POLO staff, proceed to Cashier for the
corresponding payment/s. In case there is/are questions in
the submitted contracts, Agency concerned will receive a
call from POLO staff within 24 hours upon submission to
address the problem.
- Claim the processed employment contract/s from Counter
13, 3 working days after payment/submission of complete
requirements.

- CONCILIATION-MEDIATION
Complaints by Filipino workers
against their placement agency (Philippine and Hong Kong) may be
addressed through conciliation-mediation. This mechanism enables the
parties to arrive at an amicable settlement.

Wait for your turn to be interviewed by the Labour
Officer and advised of the schedule of conciliation
meeting with HK agency. |
Step 3
|
Come back on the appointed date and time of conciliation
meeting before the Conciliator-Mediator of POLO. |
Step 4
|
If an
amicable settlement is arrived at by the complainant and
placement agency, a settlement agreement is to be
executed. If conciliation failed, the complaint will be
endorsed by POLO-HK to POEA for appropriate action. |
- ISSUANCE OF OVERSEAS EMPLOYMENT CERTIFICATEs (OECs)
ONLY VACATIONING Overseas Filipino Workers (OFWs) or those
presently working with existing employment contracts can obtain
Overseas Employment Certificate (OEC) thereby exempting them from
paying Philippine travel tax and airport terminal fees in the
Philippines.
Residents or dependents of residents who are employed in HK
should secure a Certificate of Residency/Dependency and apply for a
Travel Tax Exemption or Reduced Travel Tax before PCG.
The OEC is only valid for sixty (60) days from the date of
issuance

NOTE: Validity of OEC is indicated in all copies,
lower left side of portion. All vacationing workers who were
issued exit clearance or OEC at POLO-HK are cleared for
deployment and should not need to present documents required
under POEA 2007 package of reforms such as the TESDA NC2 for
HSWs or OWWA Certificate of Orientation/Competency on Language
and Culture at the airport.

- FILIPINO WORKERS RESOURCE CENTER (FWRC) CUSTODIAL SERVICES
FWRC is basically a 24 hour residential quarter managed and
operated by the Philippine Overseas Labor Office, providing
temporary shelter only to FEMALE distressed Overseas Filipino
Workers (OFWs) such as those whose contracts have been
prematurely terminated and have pending cases at the Labor or
Police, or Immigration Departments. Other OFWs who are in need of
emergency shelter may be allowed/considered but on a case-to-case
basis only.
Distressed OFWs admitted to stay at FWRC are required to comply
with the rules and regulations of the Center. Violators shall be
subjected to disciplinary action that may result in termination of
stay/expulsion from the Center.
It is also the venue for capability building activities to
prepare OFWs for their eventual reintegration to their respective
families and communities consisting of counseling, home life,
critical incident stress debriefing, psycho-social interventions,
case management, referrals, entrepreneurial skills and livelihood
trainings.
The FWRC which is located specifically at 2/F Block A, Post
Office Building, 650 Cheung Sha Wan Road, Kowloon, is another place
aside from the Consulate and Bayanihan Center where the vacationing
OFWs could secure OEC during Fridays, Saturdays and Holidays from
9:00 a.m. to 4:00 pm.
